Circle K Gift Card - Terms and Conditions

These terms and conditions apply to the purchase and use of gift Cards and vouchers purchased in-store at participating Circle K outlets or online at https://www.circlek.ie/giftcard available in euro (€) only. The Card is a prepaid card which means that money must be loaded onto the Card at the time of purchase or when adding additional funds. After 15 minutes from the time of purchase, cardholders can use the Card to pay for purchases at participating retailer outlets.

1.     DEFINITIONS

“Agreement” means the Agreement between you and us which includes these terms and conditions.

“Circle K” means Circle K Ireland Energy Limited, registered office at Circle K House, Beech Hill, Clonskeagh, Dublin 4, D04 YO16.

“Business Day” means any day from Monday to Friday excluding Irish bank or public holidays.

“Card” means physical gift cards purchased at participating Circle K outlets or online

“Card Transaction” means any transaction whereby a Card is used to pay for goods and/or services at Participating Retailers.

“Corporate Gift Card” means a Circle K corporate gift card purchased in accordance with the provisions of clause xx below.

“Electronic Card” means electronic gift cards or vouchers purchased online from our card Partner SVS UK Limited at https://www.circlek.ie/giftcard 

“Participating Retailer” means a retailer who has agreed to accept the Card as payment for goods and/or services.

“SVS” means our cards sales partner Stored Value Solutions UK Limited.

“Website” means CircleK.ie & https://www.circlek.ie/giftcard

2.     CARDS

2.1   Use of Cards is subject to the terms of this Agreement (which includes, as applicable, the terms of our sales partner SVS which can be found here: https://www.circlek.ie/giftcard) as may be varied by us from time to time. The current version of this Agreement is available on the Website. Purchase and or use of the Card constitutes your acceptance of it. 

2.2   Cards are valid for 5 years from the date of the last activation or purchase. On the expiry of 5 years Cards will expire and may no longer be used for purchase or reactivated, remaining balances will not be refunded. Cards purchased at participating Circle K outlets may not be returned or exchanged.

2.3   Physical Cards will normally be available for use within 15 minutes from the time of purchase; the Card may not be used in the intervening period. Cards bought online from SVS may be available for use on receipt.

2.4   Limits apply to Cards. A maximum value of €500 may be loaded onto the Card at the time of purchase, and the minimum load value is €15. Only full €1 amounts (or multiples thereof) may be loaded onto the Card. Additional amounts may not be loaded onto the Card at any time. Interest will not be payable in respect of Card balances.

2.5   Please record your Card number or retain the purchase receipt as proof of purchase; the Card number will be needed to check or redeem your Card balance. You can check your card balance at https://www.circlek.ie/giftcard/balance.

2.6   You may use Cards, in accordance with any instructions issued by us from time to time, until the Card balance reaches zero.

3.     PROTECTING YOUR CARD

3.1   You must:

(a) treat the Card as if it were cash;

(b) take all reasonable care and precaution in the custody of the Card and keep your Card safe;

(c) keep your transaction receipts safe and dispose of them carefully; and

(d) never give your Card number or any other Card information

4.     USING YOUR CARD

4.1   The Card may only be used in Participating Retailers. Electronic Cards may be used online at the appropriate e-retailer website. Stores designated as Circle K Express do not currently participate in the Circle K Gift Card Scheme. Participating retailers in Ireland can be can be found at https://www.circlek.ie/station-search. The list of Participating Retailers and how they accept the Card in store or online may change from time to time. Cards may not be exchanged for cash or other vouchers.  Cards may also be used at participating Circle K locations in Europe including Denmark, Estonia, Latvia, Lithuania, Norway, Poland, Republic of Ireland and Sweden.

4.2   Card transactions will be debited from the Card at the time the transaction takes place. If you wish to spend more than the Card balance you may pay the balance amount with an alternative payment method.

4.3   You cannot stop a Card Transaction after it has been authorised.  You authorise a Card Transaction by following the instructions provided by the Participating Retailer to authorise a transaction, which can include:

(a) swiping the Card over the card reader;

(b) where requested to do so, signing a receipt for the relevant Card Transaction;

(c) providing Card number and/or other details as requested.

The amount of the Card Transaction must be confirmed with the Participating Retailer at the time of authorisation.

4.4   Cards are for personal use only and may not be re-sold.

4.5   You can obtain your Card balance by logging onto https://www.circlek.ie/giftcard/balance and following the online instructions.

5.     LOST/STOLEN CARDS

5.1   Lost or stolen Cards cannot be replaced and we accept no liability for Cards lost, stolen or damaged. Risk in the Card will pass to you upon delivery of the gift card and title will pass upon receipt of payment in full.

5.2   Circle K excludes liability for any claims, losses, demands or expenses of any kind howsoever arising, including but not limited to any claims, losses, demands or expenses that arise in connection with the use of the Cards or anything else in connection with these terms.

6.     CHANGES

We reserve the right to amend or vary these terms and conditions in our sole discretion at any time, without affecting any purchases made.

8.     CORPORATE GIFT CARDS

Cards may also be purchased though our corporate gift card service directly from Circle K or through our distributors. Your employer may set restrictions on the types of products that can be purchased e.g. Car Wash only, Convenience Store Only, Fuel Only etc.  These restrictions will be communicated with the delivery of the gift card. 

Corporate Gift Card Additional Terms: In addition to the terms set out above the following terms shall apply to Corporate Gift Cards:

When you purchase Cards through our corporate gift card service you agree that you are making these purchases for business purposes. As a business customer, purchases you make from us will not benefit from the statutory protection available to consumers under Consumer Rights legislation.

The minimum amount which can be loaded onto any one Corporate Gift Card gift card is €15 and the maximum amount is €3,000.

Circle K reserves the right to decline any order without providing explanation.

No refunds are given for Corporate Gift cards.

You should check gift card quantities immediately upon receipt and notify us of any discrepancies.

9.     JURISDICTION

This Agreement shall be governed by and interpreted in accordance with the law of the Republic of Ireland and is subject to the non-exclusive jurisdiction of the Irish Courts.
