Circle K Extra Terms and Conditions

Terms and conditions, including privacy provisions, for membership in the Circle K Extra loyalty program. These terms and conditions apply from 27 May 2024.

Circle K Extra is a member’s program for individuals over the age of 18 and applies to retail purchases at Circle K branded service stations in Ireland. 

1. MEMBERSHIP

1.1 Consent to the processing of personal data

By accepting these terms and conditions, you are entering into an agreement with Circle K for membership in Circle K's pan-European benefits program Circle K Extra. In order to fulfil the agreement, Circle K will process your personal data in accordance with terms and conditions.

By accepting these terms and conditions, you agree that Circle K Extra may store and use your personal information in order to facilitate your membership and provide discounts within the Circle K Extra program. Personal information and information about your membership and earned benefits may be shared with other companies in the Circle K group, subcontractors, third parties associated with the provision/sale of Circle K services/goods and Circle K Extra partners both domestically and abroad. More information about our partners and subcontractors can be found in sections 4.7 and 4.8. tries. 

This Agreement and your consent only apply to the information collected, stored, and processed in connection with the Circle K Extra program. However, Circle K will also, in accordance with relevant legislation, store transaction data for purposes other than Circle K Extra, such as invoicing and accounting.

1.2 Sources of identification

In connection with this Agreement, Circle K will process transaction data from purchases made with one or more identification devices (such as loyalty member digital tag) that you have linked to your Circle K Extra account. 

1.3 Cookies

Cookies are small text files placed on your computer when you download a webpage. The purpose is to improve the functionality and efficiency of the webpage and to provide the owner of the webpage with information about your use of the webpage. Circle K Extra portal uses cookies and similar technology to optimize your experience of the webpage, e.g., to remember you when you return to the webpage and to show content that is relevant to you. You can read more about the cookies we use and why at https://www.circlek.ie/cookie.

Some of the cookies Circle K Extra uses may be used to identify your online persona.

Circle K reserves the right to use this information on an aggregated level (which cannot be linked to you as an individual) to improve the stability and functionality of the webpage. Note that you can delete cookies from your browser at any time without changing your membership status in Circle K Extra.

1.4 Withdrawal of consent

You can withdraw your consent at any time, via Circle K ID or by contacting us by email at privacy_Ireland@circlekeurope.com. Such withdrawal will also result in the termination of your membership and all the rights that follow from membership 

 

2. BENEFITS OF THE PROGRAM

Discounts/benefits will consist of:

Electronic discount coupons

Electronic vouchers

Special promotions

On selected products, Circle K offers special offers that arise after a certain number of purchases of the same product (for example, every 6th car wash purchased). An electronic stamp card will be created after the customer's first purchase of a product where such a stamp card is offered. Circle K Extra will automatically keep track of the number of purchases per stamp card.

When the stamp card is complete, the stamp card will be reset, and an electronic coupon will be sent to the customer's account. Electronic coupons will usually expire 90 days after they are created. 

The expiration date will be stated on the digital coupon. Customers can find information about available stamp cards on the Circle K Extra website.

An electronic coupon is an electronically stored value coupon that entitles the member to a discount or can be exchanged for a product or service. The coupon can only be used once and must be used before the expiration date stated on the coupon. Unless otherwise stated in the coupon offer, the coupon will only be available for 90 days from the end of the month in which it has been issued.

All Circle K Extra coupons contain digital timestamps, which are the authoritative source for any dispute regarding the validity of a value coupon. Circle K manages all Circle K Extra coupons. Circle K will receive information about when and where a coupon is redeemed. Customers can find the same information by logging into their Circle K Extra account. Contact Customer Service if you need help.

Loyalty Benefits cannot be earned for purchases of tobacco products, medicines, phone cards, lottery tickets, infant formula products, bin tags, postal stamps, vending machine purchases, gift vouchers, gift cards or saving cards/stamps. Other products may be excluded at the discretion of Circle K or by operation of the law.

If Circle K refunds or adjusts any of your purchases, we will make the corresponding adjustment to any coupon where applicable.

2.1 Special promotions

A special promotion is a limited offer only for Circle K Extra customers. It may consist of an extra discount, a gift, an extra product or similar offers.

2.2 Problems with bonus/technical errors, etc.

If an extraordinary situation arises that is beyond Circle K's control and makes it very difficult or impossible to fulfill Circle K's obligations to the customer, Circle K's obligations under the Agreement will be suspended for as long as this situation continues. After the situation has been resolved, Circle K will strive to restore or grant rights that would have been granted if the situation had not occurred.

The rights that the customer has been given under this Agreement are personal and non-transferable. The customer cannot resell or transfer discounts, coupons, or other rights granted to them as a Circle K Extra member.

Circle K may ask the customer for a written receipt or other purchase documentation to resolve a complaint if relevant data is not found in Circle K's systems or elsewhere.

2.3 No resale or transfer of rights

The rights granted to the Customer under this Agreement are personal and non-transferable. Customers may not resell or transfer any of the discounts, vouchers or other rights granted to them as a Circle K Extra member.

2.4 Circle K Fuel Cards

Circle K Extra fuel discounts which include 1c, 2c, and 3c off per litre of fuel cannot be used in conjunction with Fuel Cards.

2.5 Circle K Extra non-participating Circle K Express stores

Below is a list of sites that are not participating in our loyalty fuel offer on our Circle K app:

3. COMMUNICATION

3.1 How Circle K communicates

There are several different types of communications and marketing communications (depending on your privacy settings for communications) that are part of the Circle K Extra program:

You will receive a welcome message in the form of an SMS and/or email to verify your account and one or more follow-up emails within the first month, depending on where you are located.

There is ongoing general communication/promotional communication about Circle K Extra's offers and other products and services offered by Circle K or its partners.

There are special communications targeted to you. Based on your purchasing behavior, we may send you additional offers or information that we believe may be relevant to you based on your purchase history.

We may send discount coupons that you can use to get free or discounted items or services. Discount coupons are sent either as benefits (e.g. a free car wash because you have purchased a certain number of car washes) or in connection with milestones (e.g. on a given anniversary as a Circle K Extra member).

We may send questionnaires based on your last visit to learn more about your experience with our station, staff and products.

We may communicate to you via social media and external media channels.

Depending on the customer's preferences and geographical variations, Circle K will use email, SMS and APP (application software), telephone or postal communications or online communications to communicate with registered customers.

3.2 Communication privacy settings

When you sign up for Circle K Extra, you will receive relevant information about our offers as well as news about our and our partners' products and services.

You can choose your preferred communication channels through the privacy settings. There are separate privacy settings for your app. You can change these at any time via Circle K App.

 

4. FURTHER INFORMATION ON PRIVACY, SECURITY AND PERSONAL DATA

4.1 Purpose of processing 

Your information will be analyzed to see how you use Circle K Extra, to understand your purchasing behavior and to send you information and offers for the products or services that are most likely to interest you. We may also use your personal information to send you surveys or questionnaires to collect information about your experience of our products and services to improve our services.

The purpose of any processing of personal data under this Agreement is to operate Circle K Extra. 

Your information in non-anonymized form will not be used for any purpose other than participation in Circle K Extra on the basis of the consent you give under this Agreement.

4.2 Your rights as a data subject

How to exercise your rights

You can exercise your rights as a data subject, including the right to object or ask us questions, by or use the Contact Us section of www.CircleK.ie.  You can also contact our Data Protection Officer by sending an email to privacy_Ireland@circlekeurope.com or by writing to our Data Protection Officer at Circle K AS, Pb 1176, Sentrum, 0107 Oslo, Norway. Some requests, such as for access to data, specific questions regarding data analysis and questions about whether you can gain further access, must be submitted in writing.

Information

These terms and conditions contain information about how we will process your personal data and what information will be processed. This information can also be found on the Circle K Extra website.

Access to data

You have the right to request a copy of the information about you that we hold at any time. Most of the information is available to you on the loyalty program's web/mobile portal, which contains the data we hold about you on your Circle K Extra profile page. 

If you have specific questions regarding data analysis or other questions, you can request additional access.

Requests for access to data must be signed and be in writing.

Correction of data

If your personal data changes, you can correct your own personal data in your Circle K Extra account in App.

If you have specific questions or are experiencing issues regarding corrections or have other questions, you can request additional access. Such a request shall be in writing.

Deletion and restriction of data

You have the right at any time to request us to delete the information we hold about you or limit the use of the information to certain purposes. We may refuse to comply with your request for erasure or restriction if we are subject to a legal requirement to retain and continue processing certain personal data about you despite your request for deletion or restriction (e.g. accounting information, employment information). Request for deletion or restriction must be signed and be in writing.

Right to object to the processing of personal data for direct marketing purposes

You have the right to object to the processing of your personal data for direct marketing purposes, either by withdrawing your consent in the Extra benefit program or by sending a written request to privacy_Ireland@circlekeurope.com or by writing to our Data Protection Officer at Circle K AS, Pb 1176, Sentrum, 0107 Oslo, Norway.

4.3 How we collect and process data

The information that Circle K processes includes the information you provide when registering, information about your purchases, and other information you choose to provide to us later.

When a purchase is made at a Circle K station, Circle K records data relating to the purchase for use in business and accounting systems as in any other business. For members of Circle K Extra, data about the purchase is also sent to our loyalty system and database. These systems analyse the data to build profiles that enable us to reward you as a customer, for example with fuel discounts, and to make more targeted offers and promotions for selected customer groups.

When the data is collected, it can identify a purchase either as a specific product or service (e.g., a specific car wash program) or as the purchase of a product or service in a category (e.g., food or magazines).

Information from public databases may be used, where appropriate, in combination with Circle K Extra data. 

4.4 What information do we collect when registering?

The information we collect at the point of sale when the registration process for Circle K Extra begins is:

Email Address 

Gender (optional)

Country 

Password

In cases where customers do not complete the registration by accepting these terms and conditions, this data will be deleted after 30 days.

All this data is stored as long as the customer is active. "Active" in this context means that you have used one of the cards registered in the Circle K Extra account as identification within the last 24 months and have not cancelled your membership.

If you as a customer have been inactive for more than 24 months, the membership in Circle K Extra will be considered cancelled and the information and registrations listed above will be deleted.

4.5 What information is collected during the membership

Circle K collects transaction data about purchases and aggregates it to produce data on:

  • the amount a customer spends in different categories of fuel and other products;
  • number of visits to our stations
  • your electronic vouchers or vouchers, active or expired.
  • the percentage of our emails that customers open and whether they are returned (due to incorrect or faulty email address);
  • the percentage of customers who choose to be or not be part of a campaign (opt-out rate), and
  • How many customers click on certain ads (clickthrough rate).

We store transaction data at a detailed level for up to three years. Then the transactions are aggregated.

4.6 Protection of your personal information and respect for privacy

Circle K and its partners exchange personal data collected by Circle K Extra to manage registered customers' accounts and customer preferences information in order to offer and provide quality discounts, benefits, products, goods and services to registered customers effectively.

Circle K will not collect, use or disclose personal information about a customer of Circle K Extra without authority.

From time to time, we may transfer limited personal information to our partners for processing in order to understand what benefits, products, goods and services offered by Circle K that our customers are most interested in. This also includes the ability to share data with partners to give them a better understanding of purchasing behavior when purchasing partner products. We use both written contracts and other means to protect your information while it is being processed by our partners or subcontractors.

Circle K Extra uses predefined schedules to collect data from your transactions and then deletes the detailed logs for the transaction. We are committed to the following principles:

We collect and process only the personal information necessary to administer the Circle K Extra program, including providing our members with benefits, products, goods and services in the Circle K Extra program by analyzing members' transactions and behavior.

We will maintain the security and confidentiality of the information that the registered customers provide to us, in accordance with applicable law. Compliance with these standards is constantly verified and revised as needed.

Circle K Extra processes customers' information according to industry standards, including but not limited to PCI DSS (Payment Card Industry Standard for Data Security).

Circle K takes your privacy seriously, and we protect your personal information and comply with relevant laws. We will never sell your personal information and only exchange information with loyalty program partners as described in section 4.7.

4.7 Circle K Extra partners

Circle K's loyalty program, Circle K Extra, not only includes offers on Circle K points of sale, but may also include offers from our partners. If Circle K partners with another company: (a) for joint benefit offers; or (b) the provision/sale of Circle K service/goods; some of your information will also be made available to the partner/associated third parties solely for the purpose of that joint benefit/collaboration/provision of services/sale of goods. The same applies to information that Circle K may receive from our partners/associated third parties about you.

Information about which partners Circle K has in the Circle K Extra loyalty program and what data we will exchange from time to time is available on the Circle K Extra website.

4.8 Data processors (subcontractors), transfer of data

The personal data of the customers of the Circle K Extra program may be transferred to Circle K's subcontractors. Our subcontractors process and analyse data on our behalf. They also work with communication tools for Circle K Extra. They operate under negotiated conditions to ensure adequate privacy and data security. Circle K is responsible for any processing of information by its subcontractors.

Both Circle K's own data center and the subcontractors' data centers are located within the EU/EEC, and we will not transfer your data to locations outside the European Economic Area (EEA).

4.9 Your obligations as a member of Circle K Extra

By registering for Circle K Extra, you undertake to carefully read and comply with these terms and conditions. You also undertake to provide us with accurate and accurate information when you register and to update this information in a timely manner should it change.

You undertake to notify Circle K customer service if you experience any irregularities related to your Extra membershipYou also undertake to notify Circle K if any of the registered cards are lost or stolen. In addition, you undertake not to accept or redeem accrued benefits that you have received on an incorrect basis or that have been obtained in error.

 

5. MODIFICATION OF TERMS

Circle K may, at its sole discretion, withdraw, cancel or change these Terms at any time. A specific notice to this effect will be sent via one of Circle K Extra's communication channels and will also be published on the Circle K Extra website.

Updated terms and conditions can always be found on the Circle K Extra website. If you do not agree with the updated terms and conditions, you have the right to terminate the agreement in accordance with the procedure described in section 6.

 

6. TERMINATION

If you fail to comply with these Terms and Conditions or otherwise knowingly attempt to misuse your or others' Rewards Account, Circle K may revoke your Rewards Account with immediate effect. Circle K reserves the right to terminate the membership of any customer who engages in threatening, fraudulent or other unlawful conduct towards Circle K or Circle K employees.

Circle K reserves the right to terminate the Circle K Extra program upon 30 days' notice. In the event of such termination, all rights, discount coupons, etc. will be valid until the expiration date or for 90 days post termination, whichever is the sooner.

You can terminate your membership at any time and thereby revoke your consent to Circle K's processing of your personal data. Such termination shall be sent using the “contact us” section of www.CircleK.ie. You can also contact our Data Protection Officer by sending an email to privacy_Ireland@circlekeurope.com If you cancel your membership, any benefits, discounts or coupons you have earned will be immediately revoked. You will then no longer be able to log in to your Circle K Extra account. All Customer Benefits in your account will be forfeited as of the time of termination, all cards registered to your account will cease to earn Rewards, and Circle K will stop all Reward communications with you (except for any acknowledgement of termination and/or other regulatory communications).

 

7. OTHER PROVISIONS AND APPLICABLE LAW

These Terms and Conditions shall be governed by, and interpreted in accordance with, Irish law. Any disputes related to the Circle K Extra benefit program are subject to the exclusive jurisdiction of the Irish courts.

If any provision of these terms and conditions is found to be void, unlawful or unenforceable for any reason, that provision shall be deemed severable from these terms and conditions and shall not otherwise affect the validity and enforceability of any remaining provisions.
